Terms of Service

1. Acceptance of Terms

By accessing or using heirportraits.com (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Heir Portraits.

2. The Service

Heir Portraits generates AI-produced portrait images in an oil painting style based on photos you provide. The Service includes:

• —Digital download purchases
• —Fine art print and canvas orders via print-on-demand fulfilment

3. Your Uploads — Permissions & Warranties

By uploading photos to the Service, you represent and warrant that:

• (a) You are the photographer, the subject, or have explicit permission from the subject (or their parent/guardian if the subject is a minor) to upload and use the photos for this purpose.
• (b) The photos do not depict anything illegal, and uploading them does not violate any third party's rights, including copyright, privacy, or right of likeness.
• (c) You are at least 18 years old or have the legal capacity to enter into this agreement in your jurisdiction.

You grant Heir Portraits a limited, non-exclusive licence to process your uploaded photos solely for the purpose of generating your portrait. This licence expires when your session data and uploaded photos are deleted per our Privacy Policy. We do not claim any ownership of your uploaded photos.

4. AI-Generated Output

Nature of output. Portraits are AI-generated artistic interpretations. They are not photorealistic reproductions of the subject. Results vary and are not guaranteed to meet any particular standard of likeness or quality beyond our general style.

Licence to you. Upon completion of a free preview, you receive a personal, non-commercial licence to view your watermarked preview. Upon purchase of a digital download, you receive a personal licence to download, print for personal use, and share the portrait for non-commercial purposes. Physical print products are delivered under the same personal licence.

Restrictions. You may not: resell, sublicence, or commercially exploit AI-generated portraits produced by the Service; remove or obscure watermarks from unpurchased preview images; use portraits in ways that defame, harass, or harm any person depicted.

5. Purchases & Payments

All payments are processed by Stripe. Prices are displayed in USD. By completing a purchase you authorise the charge shown at checkout.

Digital downloads are delivered immediately upon successful payment. Because delivery is instant, all sales of digital downloads are final and non-refundable once the download link is accessed.

Print orders (fine art print, canvas) are sent to production upon payment. You may request a cancellation within 1 hour of placing your order by emailing [email protected]. After production begins, cancellations are not possible. If your print arrives damaged or materially defective, contact us within 14 days of delivery and we will arrange a replacement at no charge.

6. Regenerations

Each order includes one free regeneration of your portrait. Regenerations are processed using the same uploaded photos and selected role. Regenerated portraits may differ from the original. The regeneration allowance is tracked per session and is non-transferable.

7. Prohibited Uses

You may not use the Service to:

• —Upload photos of any person without their consent (or parental/guardian consent where applicable)
• —Generate portraits depicting illegal content, hate speech, or material that sexualises minors in any way
• —Circumvent session limits, abuse the free preview, or interfere with the Service's operation
• —Misrepresent AI-generated portraits as hand-painted or non-AI artwork in any commercial context

We reserve the right to refuse service, cancel orders, and terminate access for violations of these Terms.

8. Intellectual Property

The Heir Portraits name, logo, website design, and copy are our intellectual property. These Terms do not grant you any rights in our brand or proprietary materials.

9. Disclaimers

The service is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that AI outputs will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Heir Portraits shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid us in the 90 days preceding the claim, or $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Heir Portraits from any claims, losses, or damages (including reasonable legal fees) arising from your violation of these Terms, your uploaded content, or your use of the Service.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York.

13. Changes to These Terms

We may update these Terms at any time. We will post the revised Terms at heirportraits.com/terms with a new date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
